These Terms & Conditions (“Terms”) govern your access to and use of go.texaspowerprotection.com (the “Site”) operated by Texas Power Protection (“we,” “us,” or “our”). By accessing the Site or submitting a form, you agree to these Terms. If you do not agree, do not use the Site.

1. About Our Service

Texas Power Protection is an independent enrollment partner that connects homeowners with licensed installers and program operators participating in the Public Utility Commission of Texas (PUCT) Virtual Power Plant pilot program. We are not a utility, installer, electricity provider, or government agency. We do not generate, transmit, or distribute electricity. We are not affiliated with or endorsed by the State of Texas, ERCOT, AEP Texas, or the PUCT. AEP Texas remains the power delivery utility in its service area.

2. No Guarantee of Eligibility or Savings

Submitting our savings-analysis form does not guarantee that you will qualify for the program. Eligibility depends on factors including home suitability, credit qualification, program availability in your area, and the program operator's underwriting criteria. Any savings estimates provided on the Site, by our team, or by our partners are good-faith estimates only based on current utility rates. Actual savings vary and depend on your electricity usage, the terms of your enrollment agreement, and future utility rate changes.

3. Third-Party Services and Agreements

Enrollment in the Virtual Power Plant program requires you to enter into a separate agreement directly with the third-party program operator. That agreement governs the equipment on your home, the locked rate, service terms, and cancellation rights. Texas Power Protection is not a party to that agreement and makes no representations or warranties on behalf of the program operator. Read your agreement carefully before signing.

4. Eligibility

You must be at least 18 years old and a legal resident of the United States to submit a form through this Site. You represent that the information you provide is true, accurate, and relates to you (or you have authority to submit it on behalf of the homeowner).

5. TCPA / Communications Consent

By submitting our form, you expressly authorize Texas Power Protection and its authorized marketing partners to contact you at the phone number and email address you provided, including by:

  • Automatic telephone dialing systems,
  • Artificial or pre-recorded voice messages,
  • SMS/MMS text messages, and
  • Email.

Consent is not a condition of purchasing any goods or services. Message and data rates may apply. Message frequency varies. Reply STOP to any text to unsubscribe, or HELP for help. You may revoke this consent at any time by emailing support@texaspowerprotection.com.

6. Soft Credit Check

To determine your eligibility for program financing, a soft credit inquiry may be performed by a third-party partner. A soft inquiry will not affect your credit score and is not visible to lenders. By submitting our form, you authorize this soft inquiry for prequalification purposes only.

7. Intellectual Property

The Site and its original content, features, logos, and functionality are owned by Texas Power Protection and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Site without our express written permission.

8. User Conduct

You agree not to:

  • Submit false, misleading, or someone else's information.
  • Use the Site for any unlawful or fraudulent purpose.
  • Attempt to access, probe, or disrupt the Site or underlying infrastructure.
  • Upload malicious code or interfere with the experience of other users.
  • Scrape, copy, or republish content from the Site without permission.

9. Disclaimers

THE SITE AND OUR SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY SAVINGS ESTIMATE IS ACCURATE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXAS POWER PROTECTION AND ITS OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to defend, indemnify, and hold harmless Texas Power Protection from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in Nueces County, Texas, and you consent to the personal jurisdiction of those courts.

13. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of these Terms shall first be addressed through good-faith negotiation. If negotiation fails, the dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive any right to bring or participate in a class action. This section does not prevent either party from seeking injunctive relief in court for intellectual-property infringement.

14. Termination

We may suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to others.

15. Facebook / Meta Disclaimer

This Site is not a part of Facebook or Meta Platforms, Inc. Additionally, this Site is NOT endorsed by Facebook in any way. FACEBOOK is a trademark of Meta Platforms, Inc.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
